Byplacing an order with The Pot and Grass Company you agree to accept thefollowing terms and conditions.

Acontract is created for The Pot and Grass Company to sell you goods when weaccept an order from you made in writing, by telephone or on-line via ourweb site.

Ordersare considered accepted when we confirm the products are availableand your credit or debit card or your customer account isauthorised for thetransaction.

Thecontract for The Pot and Grass Company to supply the goods as described becomesbinding once the payment including VAT and shipping has been received by ThePot and Grass Company in full.

Payment methods accepted for online sales arecustomer account. Creditand debit cards, personal cheque, electronic transfer, money order, andPaypal.

ThePot and Grass Company will charge your credit or debit card account for paymenton receipt of your order. We accept no liability if a delivery is delayed dueto incorrect payment details.

Goodsremain the property of The Pot and Grass until full payment has beenreceived.

AllPrices (unless stated) are shown inclusive of VAT but not delivery.

Returned or represented cheque's will be charged a £12administration fee.

Prices are subject to alteration. However orders that havebeen accepted will only be charged at the prices quoted at the time theorder is accepted.

Orders that are cancelled after a transaction has been processed will incure the transaction charges for the principle transaction and the refund. The transaction fees will be deducted from the refund amount.

Refunds will usualy be made by bankers cheque made payable to customer
and mailed to the address on the original invoice.

Claims arising from shortages or damages must be madewithin 3 working days from receipt of the goods. All damaged/shortages ofparcels must be signed for or reported as damaged/parcel shortage to thecarrier.

Goods dispatched to a third party are at thepurchaser's risk.

Goods left unsecured at the purchaser's instructionsremain the purchasers risk.

All goods are subject to delivery costs unless collectedfrom The Pot and Grass Company premises in person.

All descriptions, sizes, shape, and colour of plants andproducts on the Pot and Grass web site are for guidance only. The individualproduct delivered will be true to type however may vary slightly from thedescription.

Substitute plants will not be made or dispatched withoutthe purchasers consent. If by chance a product has been ordered that isunavailable or does not meet the required company standards for shipment, thePot and Grass Company reserve the right to offer a substitute plant or plantsthat is considered the closest match. The purchaser will be informed priorto any substitution. If a substitute is not acceptable to the customer the Potand Grass Company will deduct from the order total or refund the cost of thatparticular item.

Tagging deposits paid for plants that have been reservedusing the plant tagging option will be retained as a cancellation charge if theorder is cancelled.
Plants are usually dispatched within 7 to 14 days subject to condition and availability or in some cases such as Imperator as theybecome ready.
Under the ConsumerProtection - 'Distance Selling Regulations 2000' you (the consumer) have theright to cancel your order within a 7 working day period. The cancellationperiod starts from the day that the goods are received.
The regulationsrequire that the consumer (you) to send notice of cancellation inwriting, fax, or email.* In the event of cancellation, the goods must bereturned in the same condition as delivered and at the consumer's own expense.If the goods are not returned within 7 days the Pot and Grass Company mayarrange for the goods to be collected and the incurred cost will bedebited from the refund amount. *

Unless an insurance or compensation option is offered at the checkout and clearly stated on your order confirmation/invoice, plants aredispatched without insurance cover. If insurance is required it remains thecustomer's responsibility to check the appropriate box in the check out procedure if an option is offered or arrange alternative private insurance.
Youre Responsibility.
The plants will be delivered properly packaged by first class mail parcelcarrier or courier, directly from us at the P&G.; The plants should reachyou in first class condition. On receiving the plants open the
packaging
immediately checks the order and place the plant in a light shelteredarea. Make sure the root does not dry out. Retain the packaging material. Checkand follow the planting instructions enclosed. If you are uncertain about theplanting instructions refer to the relevant web site pages. If you are stillunsure use the customer support link to get help. You must take care in theplanting and you must take proper after care of your plant.
If the plant is badly damaged during transit we will replace it or refund you.However you must inform The Pot and Grass Company immediately and make therequired report to the carrier or when signing on delivery or
Royal Mail.
The goods must bereturned/dispatched, in or with the original packaging, with proof ofposting within 3 working days from date of delivery.

No refunds or replacement can be made without the return of the plant/plants and packagingwith proof of posting Royal Mail report number.
Our customer's arevery important to us and we take any complaint you may have regarding productsand service very seriously. If you feel you have a complaint please contact ususing

giving us as much detail as you can about thecomplaint or the product including your telephone number and invoice/ordernumber. This will enable us to have your details at hand when we contact you.
We cannot be heldresponsible for failure due to adverse weather conditions or incorrect plantingand aftercare subsequent to the accepted delivery of the plants.

Please note:

P&G; Gift Vouchers are only available for credit/debit card purchase.

You will need to register a customer account to both purchase and redeem P&G; Gift Vouchers.

P&G; Gift Vouchers can only be redeemed for products advertised and available through the
Bamboo Store.

Vouchers can not be exchanged for cash.

This service is only offered between 1st September and 1st of April.

A 20% non refundable deposit is required to reserve plants. The balance payable one week before dispatch.

On
cancellation
or failure to pay the balance for an order the 20% deposit will be retained as a cancellation fee.

Plants not held in stock that are outsourced at the customers request will be charged to the customer to the at the suppliers price including vat and delivery at the time of transaction plus 25% service charge ( minimum service charge £6.50).

Plants outsourced for customers will be delivered direct from source to the customer or the customers delivery address.

Every effort is made to supply good quality plants from reputable and proven sources however. The Pot and Grass company acts only as an agent for outsourced products and has direct contact with or control of the products sourced for its customers.

When Customers request plants outsourced the Pot and Grass Company acts only as an agent for the customer in sourcing the product and will not be liable in any way for products service or shipping provided by the out sourced company.

Any complaints regarding the quality delivery accuracy of the order supplied by the outsource company is a matter between the customer and the outsource company.
